Information collection, dissemination, and use practices of Sync This Policy applies to Sync, its collection, use and storage of information on its websites (including all of its divisions and subsidiaries, collectively the "Websites") (a), and to Sync,s other information collection (including the purchase of customers lists from third parties) (b). Sync isn't responsible for the privacy or information collection practices of other web sites or apps.
1. Information Collection
Survey Information
Sync collects personal information through various methods. This includes, but is not limited to: when individuals voluntarily complete a Sync Survey, Order Form, or Registration Page online or off-line, or via online or offline survey, order forms, registration pages, and registration pages run by third parties. As used herein "online" refers to using the Internet and related technologies. "Offline" includes other methods than online such as in person, by postal mail, or using cell phones and telephones. In the Surveys Sync, or a Third Party (a "Third Party"), may ask individuals to provide various information. This may include their name, email, street address and zip code, as well as their birth date, gender and salary range. Other information may be asked, such as occupation, social insurance number, employment details, personal interests and online activities, or other information. Sync can also obtain information about an individual from a third party and combine it with the information on this website. The completion of the Surveys is entirely voluntary and there is no obligation for individuals to provide Survey Information. However, an individual could receive incentives in exchange for providing Survey Information.
1.2 Additional Information
Other times when Sync collects personal information are (1) when an Individual makes a claim or seeks to redeem an incentive provided by Liv Pure, or by a Third Party, (2) when a Person requests assistance via Sync's Customer Service Department, (3) when a Person voluntarily subscribes a Liv Pure newsletter or service (together "Other Data").
1.3 Cookies and other information collected using technology.
Sync uses web beacons and cookies to link certain Internet-related data about an individual to information in our database. Sync will also use new sources of technology information in the near future.
(a) Cookies.
Cookies are small amounts of data stored in the computer's hard drive that allow Sync to identify an individual and his or her corresponding information that is located in Sync's database. You may read more about cookies at http://cookiecentral.com. Users of websites must accept cookies to take advantage of all the website's features and functions.
Web Beacons (b)
Web beacons are a type of programming code which can be used for displaying an image on a website (by using a programming function - see http://truste.org/ for more information) but also to transfer the unique user identification of an individual (often as a cookie), to a data base and to associate that individual with information previously collected about them in a database. This allows Sync's tracking system to keep track of certain websites an individual visits. Web beacons can be used to identify products or services that an individual might be interested in and track online behavior for marketing purposes. Sync, for example, might install a webbeacon on a website of a third-party seller where fishing products are available. Bill, a person listed in Sync's database, will visit the fishing website. Sync is notified by the web beacon of Bill's visit. Sync updates Bill's profile to reflect his interest in fishing. Sync can then present Bill with offers for fishing-related products and services. Sync uses web beacons not only on its web pages but also in the emails it sends to people listed in Sync's database.
New Technology (c)
Sync's use and adoption of new technology, such as cookies and web beacons is also rapidly evolving. Sync encourages users to check this policy periodically for updates on its technology use.
1.4 Outside Information.
Sync can receive information about an individual from third parties, including public databases.
Individual Information
Individual Information is defined as Survey Information, Third Party List Information, Technology Information, Outside Information, Other Information, and other information that Sync collects about individuals.
1.6 No information collected from children.
Sync never will knowingly collect personal information on children under 13. If Sync becomes aware that it has collected information on a child younger than 13, the information will be deleted immediately from our database. Sync does not have any information about children under 13 years old to share or use. Sync designed this policy to comply with Children's Online Privacy Protection Act (COPPA).
1.7 Information about Credit Cards
Sync will in some cases collect the credit card number and other related information such as expiration dates ("Credit Card Information") from an individual when they place an order with Sync. Credit Card Information submitted to Sync is protected by SSL encryption software. Sync will only use Credit Card Information to process and complete the purchase. Credit Card Information is not disclosed to any third party unless it is necessary.
2. Use of Personal Information
2.1 Use of Information at Your Discretion.
The COMPANY may use individual information for any legal purpose at its sole discretion. The paragraphs below in Section 2 explain how Sync uses Individual Information currently, but Sync can change its use or expand it at any time. Sync may periodically update its policy, as noted below. Sync can use Individual Information for promotional offers by email, telephone, direct mail, online banner advertising and package stuffers.
2.2 Email.
Sync may use Individual Information in order to send promotional emails to individuals. Sync can maintain different email lists for various purposes. To unsubscribe, email recipients must follow the instructions provided at the bottom of each message.
2.2.a) Content of email messages
In some commercial emails sent by Sync, the name of the advertiser will appear in "From:", but pressing the "Reply button" will send a reply to Sync. In the "Subject" line, Sync emails will typically contain a message from an advertiser.
2.2(b) Solicited Email.
Sync sends emails only to those individuals who have consented to receiving email from Sync on its Websites or on websites of third parties. Sync does send unsolicited emails. Sync's emails do not comply with the laws that require certain formatting in unsolicited messages.
2.3 Targeted advertising
Sync uses Individual Information for advertising targeting. Sync will use Technology Information to link an individual to their Individual Information when they are using the Internet. Sync then shows advertising for the products and services that the individual has shown interest in through the Surveys or Technology Information. Sync can, at its own discretion, target advertising using email, direct mailing, telephones and cell phones to provide promotional offers.
Direct Mailing and Telemarketing
Sync uses Individual Information for direct or indirect advertising to individuals via direct mail or telemarketing, using telephones or cell phones.
Information Technology: Use and Information
Sync uses Technology Information in three ways: (1) to match a Person's Survey Information or Third Party List Information with other categories of Individual Information, (2) to track a Person's Online Browsing Habits on the Internet and (3) to determine what areas of Sync's website are most often visited. This information allows Sync to target advertisements and promotions according to the preferences of individual users.
Profiles of Individuals.
Sync uses Individual Information in order to create a profile for an individual. Combining Survey Information, Third Party List Information, and other sources of Individual Information like information from public databases can create a profile.
2.7 Individual Information Storage
Sync stores Individual Information on Sync computers in a database. Our computers are equipped with security measures, such as a firewall, to prevent the loss, misuse and alteration, of information that is under Sync's control. Sync does not guarantee that these security measures will stop Sync computers being illegally accessed and Individual Information stored on them being stolen or changed.
3. The dissemination of individual information.
3.1 Transfer or Sale to Third Parties
Sync may sell or transfer individual information to third parties for any purpose at its sole discretion. Please send us an email if you don't want us to use your personal information to sell or promote our products or services, or to sell, or transfer, or otherwise provide, personal information to third parties.
3.2 Order Fulfillment.
Sync may transfer Individual Information to a third party when it is necessary to deliver a product or service ordered by a user from a third-party while on Sync's web site or in response to an offer provided by Sync.
3.3 Legal Process
Sync may be required to disclose Individual Information in response to subpoenas and court orders.
3.4 Summary Data
Sync can sell or transfer information that is not individualized, such as anonymous summary information or aggregated information about individuals or subgroups.
3.5 Access.
Individuals can access their collected Individual Information to make corrections, amendments, or deletions. Contact customer service by calling the number listed on the order page. Sync may grant access to the email address of an individual to advertising clients or email service providers to verify where the Individual Information was collected.
4. Privacy Practices by Third Parties
Advertiser cookies, web beacons and other technologies.
Advertisers who place ads on websites and the Internet in general may use their own web beacons, cookies and other technologies to collect data about individuals. Liv Pure has no control over Advertisers using such technology, and Sync is not responsible for its use to collect information about individuals.
4.2 Links.
Hypertext links may be included in emails and on the Websites of third-parties. Sync isn't responsible for the privacy policies or content of these other websites. Links to third-party web sites can be found on linked web sites. These links are only provided as a convenience. Sync is not responsible for any of the information, software, services, or products available on these third-party websites. Inclusion of a hyperlink to a website does not imply endorsement of its services, site contents or sponsoring organization.
Affiliated companies
Sync reserves the right to disclose, transfer and sell Individual Information at its discretion.
